CDC Extends the Eviction Hold

CDC Extends the Eviction Hold

In early September the CDC created an additional hold on residential evictions. This hold went into effect on September 4th and extends to December 31, 2020. The order, under Section 361 of the Public Health Service Act, temporarily halts residential evictions in an effort to prevent the further spread of COVID-19. You can read more specifics about the order here, but the main point is that the order is placing a halt on evictions due to nonpayment of rent or similar housing-related payments.

Overall this new legislation creates liability for both owners and tenants if the details of the order are not followed correctly.
